Franklin Barbosa, Jr., is a creditors’ rights and bankruptcy attorney with a national practice. Mr. Barbosa represents banks, private lenders, commercial landlords, and trade creditors in bankruptcy proceedings and related disputes across the country, appearing in state and federal courts in New Jersey, New York, Delaware, Texas, Connecticut, and North Carolina. A tough, tenacious litigator with a problem-solver’s instinct for resolution, he is known for aggressively protecting his clients’ interests while keeping a disciplined focus on the most efficient path to recovery.In his bankruptcy and creditors’ rights practice, Mr. Barbosa represents secured and unsecured creditors across the full spectrum of insolvency proceedings – from lenders enforcing their collateral, to landlords protecting their lease rights, to trade creditors pursuing amounts owed. His work encompasses automatic stay litigation, debtor-in-possession financing, proofs of claim and claim objections, non-dischargeability actions, the defense of preference and fraudulent transfer claims, lease assumption and rejection disputes, and the negotiation and confirmation of plans of reorganization. Regardless of the objective, Mr. Barbosa brings a strategic, results-oriented approach to every engagement.Mr. Barbosa also maintains a robust commercial foreclosure practice, representing lenders in the enforcement of mortgages and other secured obligations. He guides clients through every stage of the process, from pre-litigation workout and default through judgment, sale, and the recovery of deficiencies, and regularly litigates contested foreclosures involving borrower-defense issues.Beyond his insolvency and foreclosure work, Mr. Barbosa litigates breach of contract, restrictive covenant, and other business disputes on behalf of companies and their principals, handling these matters from intake through dispositive motions and negotiated resolution.Mr. Barbosa has been named to the Best Lawyers: Ones to Watch® in America list in the fields of Bankruptcy and Creditor Debtor Rights / Insolvency and Reorganization Law and Commercial Litigation (2024–2026). He has also been selected to the New Jersey Rising Stars® list published by Thomson Reuters (2019–2025) and named to the Morris County Top Lawyers list (2023–2024). A frequent commentator on issues affecting creditors, he has authored articles on subjects ranging from rendering fraud-based debts non-dischargeable in Subchapter V cases to the calculation of commercial landlord rent claims in bankruptcy.Mr. Barbosa earned his J.D., cum laude, from Seton Hall University School of Law in 2015, where he served as Vice President of the Student Bar Association and Legislative Editor of the Seton Hall Legislative Journal and received the Adeline Lillian Carmela Memorial Award. During law school, he interned in the chambers of the Honorable Stuart A. Rabner, Chief Justice of the New Jersey Supreme Court, and the Honorable Cathy L. Waldor, United States Magistrate Judge for the District of New Jersey. He received his B.A. in Political Science, summa cum laude, from Drew University in 2012. Mr. Barbosa is a member of the Turnaround Management Association and American Bankruptcy Institute.Mr. Barbosa also serves on the board of The Phoenix Center, Inc. and the Friends of the Phoenix Center Foundation.
