Schenck Price Attorneys Secure Major Victory in $8 Million CERCLA Suit

Partners Timothy I. Duffy, Heidi S. Minuskin and Joseph C. Amoroso secured a major victory in favor of one of Schenck Price's large corporate clients by prevailing in a motion for summary judgment in the matter of Town of Hempstead v. United States of America, et. al. venued in the United State District Court for the Eastern District of New York. The case, which involved cutting edge environmental issues, was based on the Township of Hempstead’s attempts to recover approximately $8.4 million in response costs from Defendants associated with its construction of a water treatment system. After several years of litigation, the Court granted summary judgment dismissing the Township of Hempstead's claims against all Defendants. The Schenck Price Team persuasively argued that there was no causation to support Plaintiff’s claims and that Plaintiff failed to adhere to its obligations under the applicable National Contingency Plan.
