Schenck Price Attorney Obtains Summary Judgment for Client in a Personal Injury Case in the Superior Court of New Jersey
Frank Kontely has obtained summary judgment on behalf of his client, an HVAC subcontractor in a personal injury case in the Superior Court of New Jersey. Plaintiff was an employee of a large retailer who claimed to have slipped and fallen in a defective commercial freezer and sustained serious personal injuries and economic damages as a result. Frank filed a motion precluding plaintiff from serving an expert report. Later, he moved for summary judgment, arguing that plaintiff could not prove claims of negligent repair without an expert and that his client did not breach any common-law duty to the plaintiff.
