Community Association

  • Practical Counsel. Strategic Solutions. Decades of Experience.

Schenck Price Smith & King’s Community Association Practice Group provides comprehensive legal representation to condominium, homeowner, cooperative, and planned real estate communities throughout New Jersey. Our attorneys serve as trusted counselors to boards of directors, trustees, property managers, and community leaders navigating the increasingly complex legal and operational challenges facing community associations today.

With decades of combined experience representing community associations of all sizes, our attorneys understand that successful community governance requires more than legal knowledge alone. Associations require practical, responsive counsel that balances legal compliance, fiduciary responsibilities, financial realities, operational efficiency, and the unique dynamics of community living.

Our practice is built upon proactive guidance, accessibility, strategic problem-solving, and long-term client relationships. We work closely with boards and managers to help communities operate effectively, minimize risk, resolve disputes efficiently, and protect property values and the overall interests of their residents.

Construction Defect & Developer Transition Representation

One of the most significant events in the life cycle of a community association is the transition of control from the developer to the unit owners. This process—commonly referred to as “Transition”—requires experienced legal guidance to protect the long-term interests of the association and its members.

Our attorneys have extensive experience representing associations in complex developer transition and construction defect matters involving residential, mixed-use, and planned communities throughout New Jersey. We assist boards in identifying construction-related deficiencies, coordinating engineering investigations, evaluating potential claims, negotiating resolutions, and pursuing litigation when necessary.

The Community Association Practice Group works closely with the firm’s Construction Litigation Group, providing clients with a collaborative and strategic approach to construction-related disputes and other complex matters impacting their communities. This integrated approach allows us to deliver sophisticated representation in matters involving defective construction, infrastructure failures, water intrusion, roofing systems, building envelope issues, structural concerns, code compliance disputes, and related claims against developers, contractors, design professionals, and other responsible parties.
