Eric A. Inglis Obtains Summary Judgment Against Plaintiff Alleging a Breached Standard of Care


Schenck Price Partner Eric Inglis obtains summary judgment in favor of his client, a security company that provides wheelchair service for various airlines at Newark Liberty International Airport.

Plaintiff alleged in her complaint that Mr. Inglis’s client had breached a standard of care by prematurely terminating the wheelchair service by failing to take plaintiff from the terminal to her vehicle. Plaintiff was injured while entering an allegedly defective elevator after having to walk herself from the baggage claim area to her car.  In discovery, Mr. Inglis was able to demonstrate that plaintiff had no genuine need for his client’s wheelchair service, and convinced the court that his client’s termination of service was not a proximate cause of plaintiff’s injury.

Plaintiff suffered a serious injury that allegedly seriously impacted her life, she required surgery for the injury, and this summary judgment allows Mr. Inglis’s client to avoid a potentially substantial exposure.  The information demonstrating that plaintiff had no genuine need for the wheelchair service provided helpful color in convincing the judge to grant summary judgment.
