Appellate Division Victory

Robert B. McBriar recently secured a victory in the Superior Court of New Jersey, Appellate Division on behalf of Fredon Township. In Wolosky v. Fredon Township, et al., the Plaintiff appealed, among other Tax Court orders, the denial of his motion for counsel fees incurred in opposing the Township’s motion for sanctions. Bob successfully argued that the Township’s prior counsel filed the motion in good faith based on the Tax Court’s finding that Plaintiff’s tax appeal was frivolous, and even though prior counsel did not serve a safe harbor letter, the failure to do so did not serve as a basis for awarding counsel fees against the Township.
