Appeals Court Orders New Trial in Personal Injury Lawsuit

The New Jersey state appeals court ordered a new trial in a personal injury lawsuit by a woman who fell in a restaurant, ruling that a Bergen County Superior Court judge should not have allowed the jury to consider that she had had two glasses of wine during her meal, considering that evidence "inherently prejudicial" in the absence of evidence of intoxication.   The appeals court invoked an earlier decision in which a panel held that knowledge that a party drank alcohol was not enough to infer intoxication.  James Kassis represented the plaintiff.
