Divya Srivastav-Seth is an associate in the firm’s Health Care Practice Group. Ms. Seth concentrates her practice in health care law including administrative, regulatory and transactional matters. Her administrative experience includes representation of health care providers with respect to variety of reimbursement related issues stemming from third party payer denials or reduction of payment of benefits under state and federal law including disputes regarding calculation of reasonable and customary allowance reimbursements for out of network providers and medical necessity reviews under HCAPPA and ERISA. Ms. Seth also counsels and advises health care providers with respect to regulatory matters including compliance with federal and state prohibitions including fraud and abuse laws, against self-referral, antikickback, and HIPAA. She also advises health care providers on operational matters including certificate of need and licensure requirements under the authority of the Department of Health and the Board of Medical Examiners. Ms. Seth’s transactional experience includes advising health care providers with respect to the formation and organization and operation of professional practice entities and licensed health care facilities.
Ms. Seth is a graduate of Bryn Mawr College. She then attended Washington University School of Law in St. Louis, Missouri where she was Vice-President of the Women’s Law Caucus. She is a member of the New Jersey Bar, Health and Hospitals Section and the New York Bar Association.
