Real Estate/Land Use Department

Real estate related activities are a major part of the firm's practice. The Real Estate/Land Use Department comprises a variety of practice areas, including Residential and Commercial Real Estate, Environmental Law, Condominium Law, Real Estate Tax Appeals, Zoning and Planning Applications and Related Financing.

The firm serves as counsel to many developers, lenders and private individuals in real estate and real estate related transactions from the most basic to the most complex. Beginning with the acquisition of the land, and on through structuring and financing the transaction, obtaining all necessary governmental approvals, completion of the project, and sale or leasing of the properties, the Real Estate/Land Use Department of Schenck, Price, Smith & King offers its clients a complete range of legal services, rendered by experienced and highly-skilled attorneys.

We can assist our clients in connection with the following matters, as well as other real estate transactions:

  • Acquisitions, sales, and development of commercial, industrial and residential real estate;
  • Property development, zoning, planning and permit proceedings including preparation and negotiation of developer's agreements;
  • Real estate and project finance;
  • Environmental matters;
  • Residential purchases, sales, and refinances;
  • Formation and registration of condominium and homeowners' associations;
  • Construction, engineering and architectural agreements;
  • Resolution of construction related disputes;
  • Condemnation;
  • Title examinations, title registration and handling of title problems;
  • Commercial, shopping center, industrial and residential leases, sale-lease backs and options;
  • Mechanics lien claims;
  • Special assessment and property tax matters.

To ensure that we bring the proper expertise and experience to each matter, the Real Estate/Land Use Department interfaces with every other department of the firm -- Litigation, Business Organizations, and Tax, Trust and Estate -- on a continuous basis. In addition, the firm has an experienced paralegal staff available to assist the real estate attorneys in providing prompt, quality and efficient legal services at reasonable cost.

As an additional benefit to our clients, members of the department and other attorneys in the firm have served or are serving as counsel to various municipalities, planning boards and zoning boards, and as members of planning and zoning boards. Thus, we can draw upon a municipal perspective in analyzing and determining the best approach to use in handling a particular real estate or land use matter.
