Litigation Practice Areas

Appellate Work. The firm has an active appellate practice, and various members regularly appear before the Appellate Division and Supreme Court of New Jersey, as well as the United States Circuit Court of Appeals for the Third Circuit.

Asbestos Defense. We have extensive experience representing major manufacturers, supply houses, insureds, and other defendants in asbestos exposure cases. Our clients have included target defendants, so-called "discovery" defendants, active defendants and tangential ones.

Corporate and Commercial Litigation. The department handles all aspects of litigation for small, medium and large companies, including contractual claims, business torts, employment claims, construction disputes, property disputes and collection matters. The firm also prosecutes and defends claims for a number of hospitals and health care groups, school boards, banks, municipalities, cable television and telecommunications companies, zoning and planning boards and non-profit corporations.

Divorce Litigation. The firm represents individuals in divorce and other family proceedings in the New Jersey courts and is experienced on issues of equitable distribution of marital assets, alimony and child support, and custody and visitation. The firm also negotiates and prepares premarital agreements and interspousal agreements incident to marriage and divorce.

Employment Litigation. The firm represents employers in the evolving and complex area of employment litigation in such areas as sexual harassment, sex, age, and racial discrimination, and unfair labor practices.

Environmental Litigation. A number of our attorneys concentrate their practices in this highly specialized area, representing companies in all types of environmental suits, cleanup actions, toxic tort claims and suits against insurance carriers for coverage.

Insurance Defense. Schenck, Price has always had a substantial insurance defense practice representing numerous major insurance carriers under a variety of different policies. Attorneys in the Litigation Department have substantial experience defending personal injury and property damage claims involving general negligence, professional malpractice (medical, legal, or otherwise), environmental suits, product liability claims, construction claims and auto claims.

Personal Injury and Worker's Compensation. The firm has extensive legal experience and expertise in protecting the rights of accident victims.

Products Liability. Our firm represents many clients in defense of personal injury and property damage claims, including claims for products liability. Our clients include manufacturers and suppliers of a variety of products and equipment in the areas of construction, transportation, appliances, outdoor power equipment, machinery, pharmaceuticals and asbestos-containing products.

Real Estate Litigation. In conjunction with the Real Estate Department, the Litigation Department handles all types of real estate litigation, including appeals from decisions of zoning and planning boards, commission cases, property tax appeals and title disputes.

Special Education. Through the firm's representation of several local public school districts, our attorneys are recognized leaders in the defense of special education complaints both at the state administrative level and in the courts.

Trust and Estate Litigation. The Litigation Department works closely with the Tax, Trust and Estate Department, handling all litigated matters regarding trusts and estates, including will contests and estate claims. The Litigation Department also has an active practice in guardianship litigations.
