Health Care Law

Schenck, Price, Smith & King was one of the first law firms in the state to develop a practice dedicated to the area of health care law. One of the firm's oldest clients was Morristown Memorial Hospital, to whom the firm acted as general counsel for several decades. Since 1996, when Morristown Memorial became a founding member of Atlantic Health System, Atlantic has continued as one of the firm's major clients.

The firm's Health and Hospital Law Practice Group deals on a daily basis with such issues as patient confidentiality, patient rights, risk management, medical malpractice suits, peer review activities, withdrawal of life support, advance health care directives (commonly referred to as "living wills"), medical guardianships, institutional review boards, hospital staff privileges, contract and corporate law as applied to the health care industry, AIDS-testing issues, Certificates of Need, and a myriad of other federal and State statutory and regulatory issues.

The health care industry is heavily regulated, and subject to constant evolutionary and revolutionary changes. As a result, it is imperative that legal counsel be able to provide timely advice and assistance based upon the most current developments in the field. It is in these areas that the Health and Hospital Law Practice Group of Schenck, Price, Smith & King prides itself. The firm takes a proactive approach toward keeping abreast of health care law developments, and we are committed to responding promptly to a client's needs. In this manner, Schenck, Price, Smith & King will continue to provide its health care clients with legal counsel of the very highest quality.

The firm has experience representing independent practice associations, physician groups, hospital-based and independent physicians, county medical societies, and nursing homes. Members of the firm have acted as Hearing Officers for disputes involving hospital staff privileges, and the firm has represented physicians before the State Board of Medical Examiners.

Our health care law practice also includes the provision of legal services relating to Medicare and Medicaid, risk management, confidentiality, licensure and accreditation, organ donor and transplant laws, organizing and dissolving professional practices, medical partnerships, professional associations and joint ventures, and contract preparation, pension and tax considerations. In addition, the Health and Hospital Law Practice Group works in conjunction with the Litigation Department to provide litigation support in cases involving alleged professional liability and other health care-related issues.
