Appellate Practice

To many attorneys, a case ends after it has been tried and the post-trial motions have been decided. Such a view is mistaken, however. In today's world of never-ending litigation, a trial is often just the first stage of an extended process. Much as day follows night, appeals follow trials.

Schenck, Price, Smith & King has an active appellate practice in which attorneys guide and handle appeals in both the state and federal legal systems on a regular and frequent basis. During the past 25 years, the appellate practitioners in the firm have been chief counsel in more than 225 appeals involving a variety of issues such as fire and casualty losses, products liability law, insurance coverage disputes, administrative law, contracts, banking law, health care law, personal injury cases, trust and estate controversies, land use applications, property taxation, environmental pollution, and matrimonial matters.

Much of that appellate work has been referred to our veteran appellate attorneys by other lawyers and law firms seeking experienced practitioners to conduct the proper research, to write persuasive briefs, to engage in appellate motion practice, and to prepare for oral argument.

Our appellate practitioners have available to them state-of-the-art research tools and an extensive data bank containing over 1,000 briefs and memos that enable the firm to handle even the most complex appeal in a skillful and cost-effective manner. We tailor our efforts to the particular facts and circumstances of each appeal.

And because our appellate practitioners have regularly appeared in the upper courts for more than two decades, we have gained a depth of insight about the workings of the appellate process that is not readily available to a trial lawyer who handles the occasional appeal.

The knowledge and insight that accompany such experience can be of critical importance when presenting a case to courts, like the Appellate Division and Supreme Court of New Jersey, which are among the busiest in the nation, and to judges of those courts whose time is at a premium. An experienced practitioner may add considerable weight to the effort of capturing an upper court's interest and obtaining the best possible result for the client.
