Marc H. Zitomer
Marc H. Zitomer is a partner with Schenck, Price, Smith & King’s Business Law Department and is a member of the firm's School Law, Labor and Employment Practice Group representing statewide private and public school districts in all facets of education law and labor law. Other areas of expertise include employee performance and discipline issues, employment discrimination, tenure and seniority, school bidding and construction, employment contracts, separation agreements, sexual harassment and bullying in the school environment, student and staff First Amendment Rights, religion in the schools, student discipline, school residency law, random drug testing and board policy.
In his representation of boards of education, Mr. Zitomer regularly appears before the Public Employment Relations Commission, the Office of Administrative Law, the Commissioner of Education and the Division on Civil Rights. He provides legal guidance and strategy assistance to boards in all aspects of school law and school administration. Mr. Zitomer lectures statewide on a myriad of topics affecting public and private school districts. He serves as guest instructor at St. Elizabeth College for school administrators who are obtaining their doctoral degrees.
In addition to his expertise in education law, Mr. Zitomer provides employment counseling to businesses, corporations, corporate officers and public entities on a wide array of employment related topics, including but not limited to hiring, promotions, compensation, layoffs, discipline and discharge, harassment, substance abuse, wage and hour compliance, family leave, employee accommodations, severance agreements, employment agreements, non-compete agreements, administering collective bargaining agreements and developing effective employment manuals and company policies.
Mr. Zitomer also lectures Statewide and conducts training sessions on numerous employment law topics including sexual harassment in the workplace, the Americans with Disabilities Act, the New Jersey Law Against Discrimination, the Family & Medical Leave Act, New Jersey’s Whistleblower Law, diversity in the workplace and conducting effective internal investigations. His professional memberships include the Administrative Law Section of the New Jersey State Bar Association; the Morris County Bar Association; and Vice President of the New Jersey Association of School Attorneys. He also served as an Investigator for the District XA Ethics Committee (Morris/Sussex).
Mr. Zitomer was recognized in 2011 by New Jersey Monthly magazine as a Super Lawyer in the area of Schools & Education. He was also recognized as a “Rising Star, Super Lawyer” from 2006 through 2010. He was also recognized by the New Jersey Law Journal in its “40 under 40 Publication”, featuring New Jersey lawyers whose achievements and in public service distinguish them among their peers – September, 2004. Mr. Zitomer is the recipient of NJBIZ Magazine’s “Forty under 40 Award” which recognizes the State’s most dynamic business leaders who are under the age of 40 – July, 2009. Mr. Zitomer graduated from Muhlenberg College, B.A., cum laude, in 1992, and is a 1995 graduate of Seton Hall University School of Law.
