Gary F. Werner
Gary F. Werner is a partner in Schenck, Price, Smith & King's Litigation Department. A commercial litigator concentrating his practice in the areas of construction law and alternative dispute resolution (ADR), Mr. Werner chairs the Construction Law Practice Group at the firm. He is involved in construction contract negotiation and formation, mechanics and other lien issues, performance bond and related surety questions, and public bidding and protest issues. He also has extensive experience in all aspects of construction litigation, including scope of work issues, change orders, improper design claims, claims for defective workmanship, as well as contract balance, acceleration and delay claims.
Mr. Werner also has extensive experience in alternative dispute resolution as both a neutral and an advocate. He has been trained as a mediator. As an advocate, Mr. Werner has represented clients in binding and non-binding arbitration as well as in mediation proceedings. In addition, he is an ad hoc lecturer on ADR issues for the Rutgers University School of Law.
Mr. Werner's experience spans more than twenty years as a commercial litigator. He has appeared frequently before the United States District Court, District of New Jersey and the Chancery Courts throughout the State of New Jersey. With a broad range of clientele, Mr. Werner has represented owners such as BASF Corporation, Hoffmann La Roche, Inc., and the Murdoch Development Company, construction managers such as Bovis, Inc., and Gale, Wentworth & Dillon, general contractors such as Slattery Skanska Inc., and Claremont Construction, and design professionals such as Hillier Architectural and Gensler Associates.
Mr. Werner is a frequent lecturer on both construction and alternative dispute resolution topics and is a member of the Civil Trial Section, Construction Litigation Section, and ADR Section of the American Bar Association, as well as the Civil Trial Section and the Construction Law and Public Contracts Section of the New Jersey State Bar Association.
Mr. Werner earned his law degree in 1982 from Rutgers School of Law, serving as Editor of the Rutgers Law Review. He attended Rutgers University for his undergraduate work, receiving a Bachelor of Arts degree in 1979, with Phi Beta Kappa honors. Prior to joining Schenck, Price, Smith & King, LLP, Mr. Werner was most recently a partner with the national law firm of Kirkpatrick & Lockhart, LLP.
Mr. Werner was recognized in 2008 by New Jersey Monthly magazine as one of New Jersey’s “Super Lawyers” *.
