Gary F. Werner is a partner with Schenck, Price, Smith & King’s Litigation Department. Mr. Werner has nearly three decades of experience in General Commercial Litigation. He concentrates his practice in the area of construction law and is the Chairman of Schenck, Price, Smith & King's Construction Law Practice Group. He is also a member of the Firm’s Management Committee.

Mr. Werner’s vast commercial litigation experience encompasses partnership disputes, commercial contract disputes, restrictive covenant and trade secret litigation, as well as franchisor/franchisee litigation. His construction law practice includes surety law, bid protests, delay claims, and extra work claims, construction contract negotiation and formation, mechanics and other lien issues, public bidding, and bid protest issues.

With a background of broad jury trial experience, Mr. Werner has litigated cases and appeared in arbitration forums in both State and Federal Courts throughout the United States. He has a wide range of clients and has represented entities such as BASF Corporation, Hoffmann La Roche, Inc., and the Murdoch Development Company, construction managers including Lehrer McGovern Bovis, and Gale, Wentworth & Dillon, general contractors such as Slattery Skanska Inc., and Claremont Construction, and design professionals including Hillier Architectural and Gensler Associates.

Mr. Werner has acted as a third-party arbitrator and mediator and has been instrumental in assisting litigants to resolve multi-million dollar legal disputes. He is an ad hoc lecturer on Alternative Dispute Resolutions (ADR) issues for New York area law schools and is a frequent lecturer on construction law issues to professional associations, law schools, and construction industry trade groups. He also leads seminars for construction clients on effectively handling job-related legal issues.

Mr. Werner is a member of the Civil Trial Section, Construction Litigation Section, and ADR Sections of the American Bar Association, as well as the Civil Trial Section and the Construction Law and Public Contracts Section of the New Jersey State Bar Association.

A graduate of Rutgers School of Law, Mr. Werner served as Rutgers Law Review Editor. He attended Rutgers University for his undergraduate work, receiving a Bachelor of Arts degree in Economics (1979) with Phi Beta Kappa honors. Prior to joining Schenck, Price, Smith & King, LLP, Mr. Werner was most recently a partner with the national law firm of Kirkpatrick & Lockhart, LLP.

Mr. Werner has been repeatedly recognized by New Jersey Monthly magazine as one of New Jersey’s “Super Lawyers” * in the area of Construction Surety Law (2008-2011). Bar Admissions:
