Richard J. Conway

Richard J. Conway, Jr., is a partner with Schenck, Price Smith & King’s Business Law and Environmental Departments. He is also a member of the Commercial Restructuring and Workouts Practice Group. He has extensive transactional and counseling experience in a wide range of real estate, corporate and business transactions. He has represented buyers and sellers of assets and shares and has represented banks and borrowers in loans and other matters. In real estate matters Mr. Conway has represented buyers, sellers, lenders, landlords and tenants and applicants in municipal land use applications. His experience includes detailed familiarity with state and federal environmental compliance processes, particularly with regard to New Jersey’s Industrial Site Recovery Act (ISRA), formerly the Environmental Cleanup Responsibility Act (ECRA), liability analysis and counseling, Brownsfield Purchases and Sales and preparation for litigation. As an environmental advisor Mr. Conway regularly supervises experts and consultants and their drafting of permit applications, sampling and cleanup plans, and reports and regularly negotiates with local, state and federal agencies, both within and outside of New Jersey.

Mr. Conway also represents clients in traditional areas of environmental compliance and permitting, including OSHA, wetlands, flood plains, stormwater, CAFRA, hazardous dams, spills of hazardous substances and wastes, lender and individual liability, Superfund and New Jersey Spill Act matters, solid and medical waste management compliance matters, siting of hazardous waste facilities, the NJPDES program and related enforcement programs such as the Clean Water Enforcement Act. In many of these matters, he has actively negotiated fines, notices of violation, administrative consent orders and appeared at administrative proceedings.

Mr. Conway has lectured and written extensively on many issues. He has testified before the New Jersey State Senate and Assembly on amendments to ECRA and The Spill Act. The American Bar Association published one of his articles on bankruptcy and environmental laws. He is a Director of the New Jersey Bar Association’s Corporate and Business Law Section. He has also testified as a litigation expert on real estate and environmental issues. As a result of Mr. Conway’s efforts, the New Jersey Chapter of NAIOP (National Association of Industrial and Office Parks) honored his former law firm as its 1994 Associate Member of the Year. He has served as a member of the New Jersey DEP’s Site Remediation and Advisory Group and its task forces, including the task force on Natural Resource Damages.

Mr. Conway is a 1979 graduate of Rutgers Law School in Newark, New Jersey, with honors, and a 1974 graduate of Lehigh University in Bethlehem, Pennsylvania with both university and department honors. Between college and law school, Mr. Conway served as a Branch Manager and Lending Officer of a major New Jersey bank. After law school, Mr. Conway clerked for Judge William A. Dreier and Justice James A. Coleman, Jr., then judges of the New Jersey Superior Court, Chancery and Law Divisions. . Mr. Conway was recognized in 2009 by New Jersey Monthly magazine as one of New Jersey’s “Super Lawyers” in Business Litigation
